Depending on the place of residence and whether or not the parents have offered to support the adult, various procedures are possible.
Parents are deemed to refuse to provide information about their income when they have officially indicated so or when, after the period of time given in the request for information sent to the parents, they have not provided information about their income. When this occurs, the parents are assumed to be refusing to provide information. Consequently, without this information, it is impossible to establish the amount of the parental contribution.
Depending on the place of residence and whether or not the parents have offered to support the adult, various procedures are possible.
ADULT LIVING WITH PARENTS
When an adult is living with his or her parents or returns to their home and they refuse to provide information about their income, it is assumed that the adult’s parents are able to support him or her. NO REFUSAL TO CONTRIBUTE IS THEN CONSIDERED TO EXIST AND ASSISTANCE IS DENIED OR CANCELLED. This situation is not interpreted as a refusal to contribute since the adult’s basic needs are considered to be covered. The situation will be re-assessed when the parents will provide the necessary information.
ADULT NOT LIVING WITH PARENTS
- PARENTS PROVIDE A FINANCIAL OR MATERIAL ASSISTANCE
Even if the parents refuse to provide information about their income, if the Band and/or Tribal Council is informed that they want to contribute or that they are contributing, the benefit is determined by taking into account this assistance when it is quantifiable (accommodation, food, etc.). In this case, no action is taken against the parents since there is no refusal to contribute.
- PARENTS PROVIDE NO SUPPORT
When an adult is not living with his or her parents, they have not provided information about their income and the administration has not been informed that they want to or are providing either material or financial assistance, this situation is interpreted as a refusal to contribute. These resources are taken into account when granting benefit. The adult must exercise his or her rights or the Income Security is subrogated to these rights.
- PARENTS PROVIDE SUPPORT ONLY IF ADULT RETURNS TO THE FAMILY HOME
When the councillor is informed that the parents are offering to provide for the adult’s needs only if the adult returns to the family home, this situation is not interpreted as a refusal to contribute since the adult is not considered to be deprived of his or her means of subsistence and benefits are consequently denied or cancelled.
However, if the adult considers the offer to be unreasonable because of a difficult family atmosphere or because of the particular conditions that the parents have imposed and the adult finds unacceptable, the parents’ offer will not be retained. If the adult shows this, he or she will then receive assistance based on his or her resources. The adult must exercise his or her rights or the Income Security is subrogated to these rights.
