15.07 – Reimbursement agreement

When the debtor is no longer receiving benefits he or she must repay the debt to the Income Security within a period of no more than 36 months. The Income Security may however agree to other terms with a debtor. The minimum reimbursement required each month is $56, unless the person is an independent adult admitted to shelter or placed in the care of an intermediate resource or family-type resource (foster home), or a minor adult admitted to shelter with a dependent child, in which case the amount is $22.

 

If the debt is due to false or inaccurate information it cannot be less than $112 a month.

 

In situations involving subsequent misrepresentation, the minimum reimbursement required is $224 a month.

 

Income Security may however agree to other terms with a debtor. The reimbursement agreement concluded between the Income Security and the debtor may be lower than the regulatory standard previously described, as long as this agreement is based on the actual capacity to pay of the debtor.

 

The amount recoverable becomes payable in its entirety when the debtor refuses to repay or FAILS TO COMPLY WITH AN AGREEMENT entered into with Income Security, regardless of the latter's provisions.

 

It should be noted that each voluntary payment denotes recognition of the debt, which interrupts prescription.
