04.06.04 – Seeking employment – Lifting of the reduction

We specify that the circumstances under which the reduction determined ceases to apply definitely, when a recipient fails to comply with the obligation to take steps to find a job.

 

Three circumstances allowing for the lifting of the reduction are specified:

 

  1. the adult no longer fails to comply with the instructions;
  2. the adult agrees upon another activity to complete, namely within a Plan (with or without an employment assistance allowance);
  3.  the adult earns work income exceeding the amount of income allowed.

 

  • Failure to comply with the instructions ceases.

 

Failure ceasing means that the adult completes the activity which was the reason of the benefit reduction. As applicable, this could mean attending the regular follow-up meeting (or initial evaluation) or the information meeting of Emploi-Quebec. When the adult liable to a compulsory plan did not attend the evaluation meeting of Emploi-Quebec, he or she will have to attend it and agree upon an activity to complete within the Plan. Where the adult withdrew from the Plan, he or she will have to resume the scheduled activity or agree upon another activity to complete.

 

In any case, the reduction is lifted as of the month (or for the month of the application if reduction applied at initial evaluation) following that when the recipient expressed his or her intention to participate in the activity which resulted in the reduction, provided he or she may eventually have participated in it.

 

  • Agreeing upon another activity to complete within or without a Plan (with or without an employment assistance allowance)

 

During the initial evaluation and employment assistance interview, a recipient may agree with the Income Security officer upon job search steps, more suitable to his or her situation. Although these steps may not always be included within a Plan, they are considered as more suitable to his or her situation. The reduction ceases to apply definitely the following month, regardless of the date of the beginning of the activity. The activity agreed upon will be different from that which caused the reduction.

 

  • Earning work income exceeding the amount of work income allowed

 

The objective of the various job search activities is to enter the labor market. This is why the reduction ceases to apply definitely as of the month following which the recipient has earned an income from work exceeding the amounts of income allowed (as of the month where work income is included).

 

NOTE : A reduction of the benefit in the record upon initial evaluation also ceases to apply when the recipient has earned work income exceeding income allowed in a month during which he or she did not receive any benefit.
