04.03.04 – TLCE – Handicapped children

The Régie des rentes du Québec (RRQ) pays the supplement for handicapped children when the physical or mental handicap significantly limits the child in his/her activities of daily life for a foreseeable period of at least one year. The RRQ only reviews eligibility for this supplement for children who are under 18 years of age.

 

The allowance for a temporary employment constraint (CTE) can be granted to an adult who has custody of a child with a handicap, if they are eligible for the RRQ's supplement for handicapped children. Regarding children ages 18 years and older, the temporary employment constraint (CTE) allowance for handicapped children is granted when the RRQ has already been paying the supplement for handicapped children (or allowance for handicapped children) when the child has reached 18 years of age.

 

NOTE: When an adult child is studying full-time at the general secondary education level and a supplement for handicapped children was paid when they turned 18 years of age, it is necessary to verify their eligibility as an adult to the employment assistance program if they are faced with severe employment constraints (refer to 3.1.8.1).

 

The processing of the temporary employment constraint (CTE) for handicapped children is different depending on whether the file is received for the initial allocation or for the management of the active files.

 

  • At the initial allocation, the temporary employment constraint (CTE) allowance for handicapped children is granted for the month of the application:

 

If the RRQ pays the supplement for a handicapped child who is dependent and less than 18 years of age;

To an adult who has a dependent child who is over 18 years of age if they are eligible for a supplement for handicapped children (allowance for handicapped children) that is allocated by the RRQ when they reach the age of majority.  

 

  • For the management of active files, the temporary employment constraint (CTE) allowance for handicapped children is granted:

 

Starting from the month following the date of eligibility to the supplement for handicapped children granted by the RRQ;

Starting from the same month in which the handicapped child is added to the size of the family, if the RRQ pays the supplement for handicapped children.

 

END OF PAYMENT FOR THE RRQ'S SUPPLEMENT FOR HANDICAPPED CHILDREN

 

The RRQ stops paying the supplement for handicapped children at the beginning of the quarter following the ineligibility decision according to their payment schedule, either on:

 

  • January 1st (for the months of January, February and March);
  • April 1st (for the months of April, May and June);
  • July 1st (for the months of July, August and September);
  • October 1st (for the months of October, November and December).

 

If the decision to stop the payments is made on May 2nd, the supplement for handicapped children will be granted until the month of June, whether the payment is quarterly or monthly.

 

The payments come to an end when the following occurs:

 

  • Death of the child;
  • The child is placed by a Centre de protection de l’enfance et de la jeunesse (CPEJ) (youth protection centre) AND the parent does not pay the contribution required by the CPEJ;
  • The RRQ has re-evaluated the state of health of the child AND the child is no longer eligible for the supplement for handicapped children.

 

The processing of last resort financial assistance is as follows:

 

  • Death of the child OR placement of the child by a Centre jeunesse (youth centre) WITHOUT a reintegration plan:

 

The child is still included in the size of the family for three months following the event. The allowance for temporary employment constraints for handicapped children continues to be allocated, regardless of whether or not the RRQ pays the supplement for handicapped children.

 

  •  Placement of handicapped children into a Centre jeunesse (youth centre) WITH a reintegration plan:

 

For the placement period with a reintegration plan, the allowance for temporary employment constraints is granted for as long as the RRQ pays the supplement for handicapped children. However, the RRQ ceases to allocate the supplement when the parent client does not pay the contribution required by the CPEJ; the allowance for temporary employment constraints for handicapped children then ceases to be granted according to the anteriority of deficit rule.

 

  • Re-evaluation of a file by the RRQ:

 

The RRQ can periodically re-evaluate the child's state of health and the right to the supplement for handicapped children and then, following this re-evaluation, stop paying the supplement. If the payment comes to an end, the allowance for temporary employment constraints stops being allocated according to the anteriority of deficit rule.

 

Note: An adult with a spouse who is eligible for the 66/72 benefit is considered to form a family with the dependent children in his or her file. To be considered dependent, a child must not be related (by birth or adoption) to the spouse eligible for the 66/72 benefit. When a child is mentally or physically handicapped, the adult will be eligible for the temporary limited capacity allowance for handicapped children, providing the required conditions are met.
