03.01.02.01 – Detainee – Start and end

An INDEPENDENT ADULT becomes INELIGIBLE for last resort financial assistance from the month following that in which he or she was taken into custody.

 

An adult WHO IS A MEMBER OF A FAMILY ceases to be part of the family from the third month following that of his or her incarceration.

 

When an independent adult IN CUSTODY is RELEASED and applies for assistance in the month in which assistance was cancelled, this constitutes a new application.  Assistance is then paid in proportion to the number of days remaining in the month and the date of the application is that on which the beneficiary applies for assistance and not that on which he or she was released.  For example, if the date of incarceration is November 3, assistance is cancelled for December.  The beneficiary is released on December 3, he or she applies for assistance on December 4; assistance will be paid on a prorated basis of the days remaining in December, that is December 4 to December 31. In the case of a former detainee who has just rejoined his or her family, after the 3-month period, the case is processed as a new application or according to the principle of the anteriority of the deficit. The process retained will be the most favourable one for the affected persons.

 

Imprisoned adult eligible for the 66/72 benefit

If a person eligible for the 66/72 benefit is imprisoned, his or her benefit is cancelled for the month following the event. When the person has a spouse who is also eligible for the 66/72 benefit, the spouse becomes eligible for the adjustment for an adult without a spouse in the month following the imprisonment due to the end of cohabitation.
