13.01.07 – Remedies not exercised – Sanctions

When a person refuses to exercise his or her rights without a valid reason, the Income Security may deny the person assistance or reduce or cease paying the person benefits.

The same is true of clients who deprive themselves of rights and benefits through their own actions: for example, a person whose failure to meet obligations toward a body (e.g. the SAAQ, RRQ, CNESST, ESDC, etc.) results in the exercise of coercive powers.

Assistance is denied or cancelled to persons who state that they have worked clandestinely and who held insurable employment within the meaning of the Employment Insurance Act if they refuse to exercise their rights vis-à-vis the HRCC.

In the event that a client is denied an income by not exercising a remedy, a claim may be made.
