INDEXATION is done:
- on January 1 of each year, unless a different date is specified in the judgment;
- at the QPP rate, unless a different rate is specified in the judgment.
NO INDEXATION is done:
- where the judgment or order prohibits it; OR
- where the support is paid under an agreement between the parties resulting from mediation and that is not ratified by a judgment; OR
- where the judgment was pronounced outside Quebec and does not provide for indexation.
Where the judgment does not provide for the rate of indexation, the support is indexed at the rate established using the pension index set out in the Act respecting the Quebec Pension Plan. This rate is: |
