04.06.10 – Concept of marked carelessness and misconduct

If it is shown that a person lost his or her employment because of marked carelessness or misconduct, a financial help reduction is imposed against that person to the same extent as if her or she had refused or left an employment without serious cause.

The following actions may be considered to be misconduct :

  • being absent from work without informing the employer of the reasons for the absence unless the person had a serious cause for not being able to do so;

  • unfounded absences, that is, absences for frivolous reasons, giving some dodge or pretext as an excuse;

  • not following the work schedule (being late, leaving early) without a valid reason or without informing the employer;

  • deliberately behaving irresponsibly so as to endanger the safety of individuals or cause property damage;

  • refusing to do the work requested without any explanation or valid reason.
