When an adult is recognized as having a temporarily limited capacity for employment, he or she is granted an allowance, the amount of which depends on the individual’s personal or family situation. A REFUGEE CLAIMANT OR AN APPLICANT FOR PERMANENT RESIDENCE WHO IS MARRIED TO A PERSON LEGALLY AUTHORIZED TO STAY IN CANADA IS NOT ELIGIBLE FOR THIS ALLOWANCE.
An independent adult, the adult in a single-parent family, the spouse of a student or an adult whose spouse is able to work may be granted the TLCE allowance.
An adult whose spouse also has a severely limited capacity for employment or a temporarily limited capacity for employment may be granted a mixed allowance.
REMINDER
- a person cannot receive a TLCE allowance concurrently with a SLCE allowance;
- a TLCE allowance cannot be granted to an adult who is already receiving an employment assistance allowance from Emploi-Québec (see example in the operational section).
PAYMENT OF AN ALLOWANCE DURING THE PERIOD OF EVALUATION OF A TEMPORARILY LIMITED CAPACITY FOR EMPLOYMENT
When an officer must sent a questionable medical report to a physician for evaluation, no TLCE allowance is granted to an adult or a family already receiving assistance until the evaluating physician’s recommendation is received.
If the person is found to have a temporarily limited capacity for employment, their file is corrected retroactively and the allowance is granted the month following receipt of the medical report and for the duration indicated by the evaluating physician.
In the case of a new application, a TLCE allowance is granted as of the month of the application if the applicant provides the medical report during this month. If the evaluating physician recommends not recognizing a temporarily limited capacity for employment for health reasons, the file is corrected effective the month following the decision and no recovery is made for the period during which an allowance was granted.
When the evaluating physician’s recommendation is to recognize a temporarily limited capacity for employment, the period of time that he or she indicates takes precedence over the time indicated in the medical report.
LOSS OF ALLOWANCE
When a beneficiary no LONGER FULFILS THE CONDITIONS for receiving a temporarily limited capacity for employment allowance, he or she is informed of his or her new adult-benefit.
