A temporarily limited capacity for employment is recognized in the case of an independent adult or the adult member of a family who provides constant care to an adult whose autonomy is significantly reduced due to a physical or mental condition and who requires constant care from that adult, regardless of WHETHER OR NOT THEY SHARE a dwelling.
A person's AUTONOMY is significantly REDUCED when he or she is unable to do the following without another person's assistance or supervision:
- perform such regular daily activities as getting up, going to bed, washing, dressing, eating, bathing or showering, moving around in his or her dwelling, going outside, practising anal and bladder control (severe incontinence), administering his or her property and taking medication;
- orienting himself or herself in time and space.
CERTIFICATION REQUIRED:
- Functionally dependent people WITHOUT A SEVERELY LIMITED CAPACITY FOR EMPLOYMENT OR WITHOUT DISABILITY pursuant to the Régie des rentes du Québec, the Canada Pension Plan, any other similar plan in another country or private disability insurance plan.
In such a case, the adult must provide a PHYSICIAN'S CERTIFICATE OR an evaluation from the home care service of a LOCAL HEATH OR SOCIAL SERVICES CENTRE stating that the condition of the person under his or her care requires the constant presence of another person. An evaluation from an Health or Social Services Centre does not mean a complete evaluation of the person's condition, but simply a document or letter attesting that:
- the person whose autonomy is reduced qualifies for the home care services offered by the an Health or Social Services Centre;
AND
- if the person whose autonomy is reduced and the adult taking care of this person do not share a dwelling, the adult providing the care is identified as the “principal helper”.
- Physically dependent people RECOGNIZED as having a severely limited capacity for employment by the Income Security Program or DISABLED by the Régie des rentes du Québec, the Canada Pension Plan, any other similar plan in another country or private disability insurance plan.
In such a case, a certificate or evaluation is not required if the physically dependent person and the adult caregiver live at the same address.
If both people do not live at the same address, a certificate attesting that the permanent adult caregiver is identified as a “main caregiver” is required.
Before granting a temporarily limited capacity allowance to an adult, the advisor shall make sure the person recognized as having a severely limited capacity for employment or as disabled is physically dependent as set out above.
