04.02.09 – SLCE – Severe limitations in the capacity for employment

The finding of SEVERE LIMITATIONS IN THE CAPACITY FOR EMPLOYMENT becomes apparent from the file. Since each file is an individual case and given the interaction between the medical and socio-occupational components and the variety of possible cases, this finding requires judgment on the part of those who analyse the file.

 

When the client's complete profile has been established, it is compared with the requirements of various positions. All positions are deemed to be of the same value for the purposes of a last resort financial assistance program.

 

Furthermore, the availability of jobs in a particular region is not taken into account, because it is the person's inherent characteristics that must be considered.

 

To determine whether there are severe limitations in the capacity for employment, it must be ascertained whether the person has the physical and mental capacities and the socio-occupational profile needed to work full time (in accordance with the Quebec reality) in a steady (pace) and continuous (duration) manner. The person's residual work capacity must enable him or her to meet the performance and adjustment requirements of a few positions that exist and to keep those positions. It is not enough that the person is able to perform each of the actions involved in a job; the person must also perform them according to recognized requirements in the sector of activity in question.

 

The limitations in the capacity for employment are severe, that is, serious and significant, when they prevent the person from occupying such positions.

 

The National Occupational Classification (NOC) and related documents may be used to analyse clients’ severe limitations in their capacity for employment. These documents provide information on occupational requirements in terms of training, skills, physical activities and environmental conditions.
