A person must reside in a First Nation community in Quebec in order to be eligible for financial assistance under the program of the Income Security Framework Policy.
A person who is absent MORE THAN 7 CONSECUTIVE DAYS OR MORE THAN 15 CUMULATIVE DAYS IN THE SAME MONTH is no longer considered to be residing in Quebec. However, a dependent child ceases to reside in Quebec as soon as the child is absent for one complete calendar month, that is, for a period running from the first day to the last day of that month.
When an adult is absent from Quebec more than 7 consecutive days or more than 15 cumulative days in the same month, that person’s file is cancelled for the following month. For example, the allowance for a client who is absent from Quebec from November 3 to November 19 will be cancelled for the month of December.
However, the financial assistance for a person who PERMANENTLY leaves Quebec will be cancelled for the month following that person’s departure, regardless of the number of days that the person is absent in the month of his or her departure.
TEMPORARY ABSENCE – ELIGIBILITY FOR FINANCIAL ASSISTANCE
A person continues to reside in Quebec and to be eligible for financial assistance even if that person must BE TEMPORARILY ABSENT for one of the following reasons:
- To RECEIVE the treatment required by his or her physical or mental condition, on the written recommendation of a physician entered on the roll of the Ordre des médecins du Québec and for the duration indicated on that recommendation;
- To RECEIVE services or participate in educational programs in the language of their choice
- To ACCOMPANY, for a period of not more than 6 months, the person who provides him or her with the constant care required by his or her physical or mental condition;
- To ACCOMPANY a person to whom he or she PROVIDES constant care and who must be absent from Quebec in order to receive the treatment required by his or her physical or mental condition, on the written recommendation of a physician entered on the roll of the Ordre des médecins du Québec and for the duration indicated on that recommendation;
- To ACCOMPANY, for a period of not more than six (6) months, a family member who leaves Quebec to pursue his or her studies, receive treatment required by his or her mental or physical condition, participate in an employment measure or perform paid work, or for any other reason deemed valid. The person can justify accompanying the person through family support in the broad sense;
- To PARTICIPATE in an employment assistance measure or program;
- To PARTICIPATE in traditional activities or to visit members of the immediate or extended family;
- To perform REMUNERATED WORK, and for the duration of such work, if he or she is a member of a family residing in Quebec.
CASE OF FORCE MAJEURE
A person who is forced to remain away from Quebec due to a CASE OF FORCE MAJEURE continues to be considered to be a resident of Quebec for a period of not more than 6 months.
In all cases, the person is not required to maintain a residence in Quebec.
PERSON WHO TAKES REFUGE IN A SHELTER FOR VICTIMS OF VIOLENCE
A person who takes refuge in a shelter for victims of violence located OUTSIDE QUEBEC is still considered to be a resident of Quebec, since the address of the shelter is a temporary one.
