The adult who does not reside in a Quebec First Nation community is INELIGIBLE for employment assistance except in the following cases:
- He/she is receiving the care required by his/her physical or mental state based on the written recommendation of a physician who is a registered member of the Ordre des médecins du Québec and for the duration of the physician’s recommendation;
- He/she accompanies, for no more than six months, the person who provides him/her with the constant care required by his/her physical or mental state;
- He/she participates, in the framework of a course and its anticipated duration, in an employment assistance program or measure;
- He/she performs remunerated work for its duration if he/she is the member of a family residing in the community;
- He/she supports the person mentioned in point 1 and provides him/her with constant care because this person’s autonomy is significantly reduced because of his/her physical or mental state;
- He/she is retained outside of the community for a period no longer than six months for a case of force majeure.
RESIDENCE
A person who leaves on a temporary basis by virtue of the exceptions that were previously cited in paragraphs 1 to 6 is not obligated to maintain a residence in the community.
A RESIDENCE is defined as the place where the person and, if applicable, the family usually reside. The residence, in the literal and strict sense, is the place where one currently resides; it takes on its meaning through habitation and is lost in the same manner. An absence for a few days, such as for a trip, does not cause a residence to change if it is demonstrated that it was only left accidentally and that the intention is to return soon.
The notion of residence is usually a matter of FACT. It involves certain STABILITY and PERMANENCE in a given place and is not associated with tourism or visitation.
