03.01.02.08 – Adult in prison – Family member

An adult member of a two parent family ceases to be part of the family starting from the third month after incarceration.  Financial assistance is therefore reduced starting from the fourth month.

 

A. BEGINNING OF INCARCERATION

 

The three month delay is granted in order to allow the family to adjust its budget and financial situation due to the absence of one of the members.  This delay is applicable even if the family was not receiving assistance at the time of incarceration or detention.

 

B. END OF INCARCERATION

 

B.1 End of incarceration after a period of LESS THAN THREE MONTHS

 

The adult person who is released from prison or detention continues to be a member of the family when the total time of imprisonment lasts LESS THAN THREE MONTHS starting from the date of incarceration or detention. Financial assistance continues to be paid to the family.

 

B.2 End of incarceration after a period longer than three months.

 

When the adult returns to the family, the situation is treated as a new application or in accordance with the principle of a prior deficit.  The treatment most favorable to the individuals concerned must be chosen.

 

Imprisoned adult eligible for the 66/72 benefit

If an imprisoned adult has a spouse who is a client of the Income Security Program, the imprisoned adult and any dependent children are not considered as forming a family in the three months following the event. In the fourth month, the children can be added to the file of a parent who is a client of the Income Security Program and not eligible for the 66/72 benefit, if the other parent is still not eligible for the 66/72 benefit (see section “Adding a dependent child”).
