03.01.02.05 – Adult on probation

A person subject to a probation order is not regarded as a detainee.  Such a person is ELIGIBLE FOR LAST RESORT FINANCIAL ASSISTANCE.

 

A person on probation is a person who is subject to a probation order made by the court requiring him or her not to create public disorder, to observe the rules of good conduct and to appear before the court when summoned.  Such an order may require the person concerned to meet regularly with a probation officer for a specific period and, as the case may be, may impose other conditions such as a duty to reimburse the victim.

 

The probation order may be made instead of a prison sentence or to complete a prison sentence.  A person on probation is released as long as he or she complies with the conditions mentioned in the order.  Like any other individual, he or she assumes all the responsibilities inherent in earning a living.

 

The probation order may oblige the person to reside in a drug rehabilitation centre. This person is ineligible to last resort financial assistance; however, he or she may receive assistance by virtue of discretionary power. The amount granted will be the regular benefit.

 

For the beneficiary be deemed to reside, the order will oblige the beneficiary to reside at the centre’s address. If the order states that the beneficiary must undergo treatment, without specifying the requirement to reside at the centre, he or she is not required to do so.
